What a Power of Attorney is used for

A Power of Attorney (POA) is a legal document by which an owner authorizes another person to act on their behalf for defined purposes. In property matters, NRIs commonly consider one when they cannot travel to India for signing, registration, or local coordination.

A POA is a legal instrument. How it must be drafted, executed, attested, and registered — and whether it is accepted for a particular step — is a question for a qualified lawyer in India. Nothing here should be treated as legal advice.

Scope matters more than most owners expect

The most frequent source of delay is a POA whose wording does not cover the exact act that a sub-registrar, bank, or buyer's counsel requires. A narrowly drafted, transaction-specific POA is usually preferred over a broad one, and it should name the acts it authorizes plainly.

  • Name the attorney-holder precisely, with identification details
  • State how long the authority lasts and how it can be revoked
  • Confirm with your lawyer how it must be attested where you live
